Senior Housing Industry and Zoning

By 2050 the nations senior population of adults 65+ will be over 89 million or 20 percent of the total population according to the US. Census Bureau. As the senior citizen population of USA grows, more housing options catered towards this demographic will be needed.

To operate or construct any facility like above requires zoning approval. Zoning is an area of law, which dictates how the property can be constructed and used. Zoning is a complex and complicated area of the law, which has been slow to change. Zoning laws establish regulations and requirements controlling the location, construction, modification and use of structures and land within a city. Municipalities generally create zoning districts in order to effectively execute these particular laws. Zoning districts regulate what activities are permitted in different parts of the city.

Many existing land use ordinances do not mention the above-listed senior housing options. This may be due to the fact that the demand for senior housing has increased so dramatically in the last few years. Since zoning is slow to changing business and demographic conditions, it has not caught up.

Most municipalities have 3 zoning district - residential, commercial and manufacturing. A commercial real estate development company seeking to develop a site as a retirement facility within a residential district will have to convince the zoning board. The real estate firm may have to seek a zoning variance or a special use permit to allow the development of the retirement facility. This might be a long and complex process.

The need for senior housing will continue to grow in the near future. As a result, states and municipalities will have to update their zoning codes to encourage senior housing options.
